PURPOSE

This Constitution provides a guide to those individuals seeking office.  Its intent is to establish consistent election criteria and the structure of the organization.

ARTICLE ONE-MEMBERSHIP

Section One:
Every member of the Student Council must be a student in good standing, meet academic eligibility, and be able to perform the duties of the office.  These duties and obligations are outlined in the Oath of Office contract, Council Application, and Council Contracts.

Section Two:
The organization will consist of two faculty members residing as the advisors and moderators; an Executive Board consisting of:  a President, Vice President, Secretary of Correspondence, Secretary of Records, Treasurer, Parliamentarian, and Historian; Senior Class Officers, Junior Class Officers, Sophomore Class Officers, Freshman Class Officers, and Class Representatives.  The residing Principal of Fort Campbell High School prevails over the entire Student Council.

ARTICLE TWO-JOB DESCRIPTION

Section One:
Every position in the Student Council described in Article One shall possess its own unique job description whose contribution benefits the organization. Executive Board duties, Class Officer duties, and Representative duties are outlined on the Council Contracts. 

Section Two:
The Executive Board shall serve as a collective unit, serving for the school year, encompassing those individuals serving as President, Vice President, Secretary of Correspondence, Secretary of Records, Treasurer, Parliamentarian, and Historian. 

ARTICLE THREE–COMMITTEES

Section One:
There will be the following Standing Committees, each with chairperson(s) on the Student Council:

  • Community Service/Service Learning
  • Homecoming
  • Leadership Conferences
  • Talent Show
  • Fundraising
  • Class Olympics
  • Pep Rallies
  • Terra Nova

ARTICLE FOUR- POWERS

Section One:
Only the residing Principal of Fort Campbell High School possesses the power of veto over any motion made by the Student Council.  No member of the Student Council possesses the power to overrule a veto motioned by the Principal.

Section Two:
All the powers of the Student Council are delegated to it by the Fort Campbell High School administration.  Its principle powers shall be:

  • To coordinate all student activities under its jurisdiction
  • To be the voice of the Student Body to the administration and faculty
  • To enforce the Oath of Office through its own Judicial Body.

ARTICLE FIVE-DISMISSAL FROM OFFICE

Section One:
An officer or representative shall be removed from office for repeated failure to carry out his/her duties as an officer or representative or for other actions which are detrimental to the welfare and best interest of the school. This includes behavior inappropriate of a school leader to include behavior at school, at school activities, and outside of the school environment.. 

Section Two:
Members of the Student Council will sign an Oath of Office, a Point System Contract, and a Council Contract for each position.  If for any reason, the duties stated within the body of either of these documents are not fulfilled, the member will have points deducted from his/her total and the possibility of going before the Judicial Committee as outlined in Article Six. 

Section Three:
The Student Council will operate on a Point System for all members of the Council.  Each member will begin the year upon election with a total of 20 points.  Points will be deducted for not fulfilling duties as outline in the Constitution, Council Contract or Oath of Office.  The point deductions will be monitored and recorded by the Parliamentarian. The Point Deductions are as follows:

  • 3 points for missing a general meeting: unexcused absence
  • 3 points for missing three general meetings: upon accumulation of 3excused absences. An excused absence will be counted for those members that leave early or arrive late to a meeting. An absence is considered excused only when prior arrangements are made with the parliamentarian or the advisors or absent from school the day of the meeting.

  • 2 points for missing a committee meeting (excused or unexcused)
  • 3 points for missing a Student Council sponsored and planned event (i.e., examples but not limited to fundraising events, community/school service projects, dances, faculty events, retreat, etc)
  • 2 points if signed up and did not fulfill their duty (i.e. examples but not limited to working an event, bringing in a good or food item, setting up or cleaning up after a Student Council function, etc.)
  • ½ point for talking during meeting
  • 2 point each time a duty is not fulfilled as outline in Council Contract (i.e., Executive Board, Committee Chairs, Special Chairs, Executive Chairs, Class Officers, Representatives)
  • 5 points for not fulfilling required number of community service hours (3) per semester
  • 1 point for every week mailbox is not checked (mailbox must be empty by Friday at 3 p.m. of each week)
  • 2 points for each time a student serves an after-school detention.
  • 5 points for each time a student serves Saturday School
  • 2 point for each time a student serves a Teacher Detention
  • 10 points deduction for each day a student is suspended and mandatory judicial meeting for review of removal from Council.

Section Four:
If an officer or representative resigns or is removed from office, a new officer or representative will be appointed at the discretion of the Executive Board with approval from the Advisor and Administration.  If an officer resigns or is removed from office, the Student Council is empowered to fill the vacancy by simple majority vote except in the case of the President, in which case the Vice President shall become President.

Section Five:
Grade point averages will be checked at the end of each nine weeks. Council members who do not maintain grade point averages for their specific office will be placed on probation.  All Executive Board officers must maintain an overall 3.0 average.  All Class Offices and Representatives must maintain an overall 2.5 average.  If grades are not brought up to the needed requirement by the next report card, the student will be removed from office. 

ARTICLE SIX- JUDICIAL REVIEW

Section One: 
The Judicial Committee will serve under the Office of Parliamentarian.  The Parliamentarian will have voice but no vote on this committee.  In the event that any member of the Student Council engages in any activities that are outside of the guidelines set forth by the Code of Conduct, Points Contract, or Student Council contract, a Judicial Committee will be held.  Further, if a member of the Council is assigned Saturday School, After School Detention, fallen to 5 points on the point system, received any reprimand from a FCHS School Administrator or Faculty member that warrants a judicial hearing, a Judicial Committee hearing will be called by the Parliamentarian.  This meeting must occur with in 10 school days of the offense.  The Parliamentarian will notify the member being called before the Judicial hearing by letter.  The Parliamentarian will then convene the Judicial Committee which will consist of 1 representative from each Class, 1 class officer (not from the grade in which the person going before the committee is in), and 2 Executive Board members.  The Advisor will sit in on the meeting he/she will have voice but no vote.   All Judicial Committee hearings will be kept confidential.   The Principal will be informed in writing of the holding of the meeting and the outcome of the meeting.   Failure for a member called before the Judicial Committee to attend an assigned judicial meeting will result in removal from the Council.

Section Two:
If a member is called before Judicial, witnesses for testimonial are allowed within the hearing to provide statements for the Council member. 

Section Three:
The decisions of the Judicial Committee are to be fair and impartial.  Judicial hearings are to be concerned only with the incident that is being discussed.   Only background material that relates directly to the incident can be introduced at the hearing.  Previous Judicial reviews may be entered into the record of any member who appears before the Council.  The Judicial Committee has the authority to remove a member from the Council upon unanimous decision once all evidence is weighed in the matter being discussed before the committee.  The Judicial Committee also has the power to assess demerit deductions and probation to any member on the Council before the Committee.  The decision of the Committee is final upon review from the Principal. 

Section Four:
Judicial Committee reviews are closed sessions.  Notes on Judicial hearings will be kept only by the Parliamentarian.  Members who serve on the hearing should take this as a sacred trust and refrain from discussing comments or outcomes with anyone once the hearing is over.

ARTICLE SEVEN-ELIGIBILITY OF OFFICE

Section One:
All students seeking office will be self-nominated.  Candidates must submit their application and teacher references the Friday before campaigning to a Student Council sponsor (timeline will be on the application).

Section Two:
Any student seeking to occupy a Student Council position must fulfill the following prerequisites:

  • Shall be in good standing with the Administration of FCHS.
  • Shall have cumulative grade point average high than 3.0 for Executive Board and 2.5 for Class Officers and Representatives.
  • Shall have completed the Application for Office.
  • Shall express appropriate characteristics common of a Student Council member through his words and actions both in and out of school.
  • Shall sign the Oath of Office and Council Contract.
  • Shall have Parental Consent to run for office.

Section Two:
The Student Council President shall be elected from the incoming 11th and 12th grades.  The Student Council President
shall not reside as the President of any other FCHS extracurricular group, Producer of Blue Review, or Editor of the yearbook in order to eliminate time conflicts towards the Council.

Section Three:
The Vice President will be elected from the incoming 11th or 12th grade.
The Secretary of Correspondence, Secretary of Records, Treasurer, Parliamentarian, and Historian will be elected from the incoming 10th, 11th, or 12th grade. The Student Council Executive Board shall not reside as the President of any other FCHS extracurricular group, Producer of Blue Review, or Editor of the yearbook in order to eliminate time conflicts towards the Council.

Section Four:
All members of the Student Council will be required to perform a minimum of three hours of community or campus service per semester as outlined in the Oath of Office.  These hours will be above and beyond the required 80% participation in all sanctioned Student Council events.  As campus leaders it is our duty to give of our own time to serve others.

Section Five:
If a member is removed from Student Council by the Judicial Review that student cannot hold office, but may be a class representative during the following school year.

ARTICLE EIGHT- QUORUM

A quorum shall consist of 2/3 of the Student Council and shall be applied for all official voting unless otherwise necessary as decided by the President.

ARTICLE NINE- ELECTION PROCEDURES

Section One:
Nominating and Election Procedures:

  • Executive Officers elections will be held in early May.  Class Officers elections will be held in August.
  • Students will be self-nominated for office.
  • An application must be completed and returned on time.
  • Campaigning will be conducted three (3) days prior to the election date. 
  • Speeches by students seeking office will be taped.  The speeches will be written and previewed by the Student Council advisors prior to taping.
  • Interest questionnaire completed and turned in with application.
  • Executive board will be interviewed by the advisors before the election.

Section Two:
Voting Procedures:

  • Student Council sponsors will distribute ballots to seminars prior to Election Day.
  • In the event that there is a tie during Executive Board Elections, advisors and administration will declare the winner based on the interview process.
  • In the event that there is a tie during Class Officer Elections, a run-off election will be held between the top two candidates.  The candidate receiving the most votes during the run-off election will be declared the winner.
  • Elected officers will be announced during morning announcements the day after elections are held.
